What We’re Watching: Senate Bill 121

With just over a month left in the state legislative session, bills are moving through key committee hearings a s they near the finish line. This week, we’re watching Senate Bill 121, which addresses overtime requirements for agricultural workers.

Beginning January 2027, the bill would require agricultural employers to pay overtime to certain employees who work more than 56 hours in a week. It also removes the authority of the state labor division to set overtime rules through regulation, instead establishing the threshold directly in statute.

The Colorado Chamber’s Labor and Employment Council took a support position on the bill, as the established overtime threshold accurately reflects the realities of agricultural work. Unlike many other industries, agriculture depends on seasonal cycles, weather and harvest timing, making flexible work hours essential. Setting a clear standard provides more certainty for both employers and workers while recognizing the unique demands of the industry.

SB 121 passed the House Agriculture, Water & Natural Resources Committee on a 10-3 vote on Monday and will continue moving through the legislative process.
