Feedback Requested on Potential Legislation

At the behest of the Office of Governor Polis, the Colorado Department of Labor and Employment (CDLE) is proposing legislation to require employers to provide notices to their employees of their eligibility for certain tax credits. These credits include the federal and state Earned Income Tax Credit (EITC), Child Tax Credit (CTC), and Child and Dependent Care Tax Credit (CDCTC). According to CDLE, a notification would lead to an increase in the use of these tax credits.

The proposal would require employers to deliver a separate paper notification mailed or hand-delivered to all employees (both W-2 and 1099 employees), while also encouraging employers to include email notification. According to CDLE, the Department of Revenue (DOR) could provide sample text translated into a variety of languages with a link to a website with free tax help resources. CDLE could also send notifications to employers regarding this new requirement.

Here is CDLE’s talking point sheet with more information. The Chamber will provide a draft bill once we receive one. Any feedback you can provide on how this new requirement would impact your company is greatly appreciated. Please send feedback as well as questions to Meghan Dollar, SVP of Governmental Affairs and Political Operations ([email protected]) or Larry Hudson, contract lobbyist ([email protected]). Any feedback would be appreciated by COB December 7.
