The Colorado Chamber has played an active role as a party in the proposed Greenhouse Gas and Energy Management for Manufacturing Phase 2 (“GEMM 2”) Rule before the Air Quality Control Commission (AQCC). The GEMM 2 rule will set standards and guidelines for GHG emissions in the manufacturing sector. The Chamber has filed several motions advocating on behalf of affected companies in Colorado and will continue to prepare for the rulemaking hearing on September 21st-22nd. As of this writing, the rule is still missing key components needed to ensure operators subject to the Proposed Rule have a pathway to compliance.
As a result, the Chamber submitted a letter to Governor Polis respectfully asking that he support the inclusion of a GHG Reduction Account in the language of the rule at the 2030 social cost of GHGs of $89 per ton of CO2e. The letter further describes outstanding concerns with the rule in its current draft. The letter can be found here.
