Division of Labor is Seeking Public Comments on Minimum Wage Order

Please be advised that the Division of Labor Standards and Statistics within the Colorado Department of Labor and Employment (CDLE), is seeking public comment on potential changes to the Colorado Minimum Wage Order, 7 CCR 1103-1, and specifically on three areas:

  1. Industry Coverage: Currently, the Minimum Wage Order 35 regulates the following four industries: (1) Retail and Service; (2) Food and Beverage; (3) Commercial Support Service and (4) Health and Medical. Should Colorado expand the categories of covered employees in Section 1 of the Minimum Wage Order?
  1. Minimum Salary for Exempt Employees: Should Colorado implement a minimum salary required to be paid to employees covered by the exemptions in Section 5 of the Minimum Wage Order? If so, what should that minimum salary be?
  2. Comments: Are there other changes to Colorado Minimum Wage Order 35 that should be considered?

Any comments can be submitted to [email protected] by August 16, 2019. Please include “Minimum Wage Order” in the subject line when submitting comments.

Additionally, the Division will be holding a Stakeholder Pre-rulemaking Exchange And Kickoff (“SPEAK”) meeting on August 28, 2019 at 1:00p.m. at the CDLE office located at 633 17th St, conference room 12A. The goal of the SPEAK meeting is to allow for in-person comments on any publicly posted written comments.

All written and oral comments will be reviewed by the Division and will be used to develop formal rulemaking on the Minimum Wage Order, pursuant to the State Administrative Procedure Act, C.R.S. § 24-4-101, et seq. Additional information on Colorado’s Minimum Wage Order is available here.
